Rentalee Terms and Conditions Listing and booking provisions apply when the corresponding service is available. Rentals can be booked only when online booking is enabled for that listing.
Version 1.6. Publication date: 30 October 2026. These Terms apply to new agreements accepted from this date; they do not retrospectively replace an existing agreement.
These Terms govern your Rentalee account, your use of our marketplace and bookings made through it. Part A applies to every account holder and person making a booking. Part B contains the rental terms adopted by participating rental businesses. Part C also applies to rental businesses and other users acting for business purposes as stated. Mandatory legal rights prevail over these Terms.
Part A Common platform terms
1. Operator and contact
Rentalee is the trading name of Justo van Doesum, a self-employed operator established in Spain. Spanish tax identification number: Y5499131Y. Address: C/ Alicante 013, ex:1, pl:00, pt:03, 03501 Benidorm, Alicante, Spain. Email: info@rentalplugin.com. You may also contact us through the Help or Report a problem link on the platform. References to Rentalee, we, us or our mean this operator.
A rental business identified in a listing and booking confirmation is the Seller. A person booking or using a rental is the Renter. The Platform means Rentalee websites and booking interfaces that refer to these Terms. A Consumer is a user acting outside their trade, business, craft or profession under the applicable law.
2. Acceptance and documents
You must actively accept these Terms before we create your account. You must also accept the Terms and the rental conditions presented for each booking before submitting it, whether you book through an account or as a guest. A Seller must additionally accept Part C and the commission or commercial schedule shown to it before onboarding is completed. If you act for another person or business, you must have authority to bind that person or business.
The booking summary, the Seller's identity, the selected cancellation conditions and any category or Seller-specific rental conditions disclosed before the order form part of the rental agreement. An agreed commercial schedule forms part of the Seller's agreement with us. No hidden policy or material condition first presented after booking is incorporated by this clause.
Mandatory law takes priority. For the rental agreement, expressly agreed booking particulars and more favourable express Consumer commitments take priority over inconsistent general rental wording. Category and selected cancellation conditions then apply, followed by Part B. Part A governs our platform service; Part C governs our relationship with Sellers. Payment-provider terms govern their own services. No precedence rule removes a mandatory right. You can save or print the Terms, and we will supply the applicable booking information in a durable confirmation.
3. Our role and the rental supplier
We provide a marketplace through which independent Sellers advertise rentals and Renters find and book them. The rental agreement is between the Renter and the Seller named before booking. The Seller supplies the equipment and rental service, controls its inventory and is responsible for its lawful operation, condition, maintenance, instructions and fulfilment. Rentalee does not own or operate that equipment merely because it appears on the Platform.
We provide the platform services described in these Terms, transmit and administer bookings and may assist with payments, refunds and complaints within the authority granted to us. We remain responsible for our own contractual obligations, representations and duties imposed by law. Our involvement in assistance or administration does not itself transfer the Seller's rental obligations to us. We do not provide insurance or guarantee a Seller's solvency or performance unless a separate express guarantee says so.
4. International use and eligibility
Renters may come from different countries. Seller onboarding is available only in European countries and rental categories that the Platform enables. Access to the website does not establish that every service is offered or legally available in every country. Each booking identifies the Seller and the location where the rental is supplied.
You must be at least 18 and have legal capacity to enter the relevant agreement. Additional age, licence, training or eligibility conditions must be displayed before booking. Sellers must comply with the laws where they operate and supply rentals. Users must comply with laws applicable to their own conduct. We may restrict services where necessary to comply with legal restrictions or supported payment-provider requirements; we will not apply unlawful discrimination. These Terms do not exclude mandatory rights that apply because of a Consumer's residence or other legally relevant circumstances.
5. Accounts and security
Provide accurate information and keep material details current. Keep access credentials and booking-management links secure, use reasonable security precautions and notify us promptly of suspected compromise. You are responsible for activity you authorize and for losses legally attributable to your own breach of these duties. You are not automatically responsible for every unauthorized act simply because it used your account.
Do not impersonate another person, create fraudulent bookings, misuse someone else's payment method, bypass security, interfere with the Platform or evade a lawful restriction. Guest booking links must only be shared with authorized persons. We may require proportionate verification for security, payments, legal compliance or access to personal information.
6. Listings ranking and reviews
Listings identify the Seller and describe the offered rental. Sellers are responsible for the information they supply. We exercise the care required of us when operating the Platform and respond to reported errors or illegal content. A label such as Business profile reviewed describes the specific checks explained alongside that label; it is not a certification of equipment safety, insurance, quality or future conduct.
Search results depend on your selected location, radius, category, dates and available information. The current closest-first option orders results by the distance calculated for the search location; the price options order by the displayed rental price for the stated basis. Date availability is subject to the final stock check before confirmation. We will identify advertising or paid placement and explain material paid influence if introduced. Search coverage is limited to participating Sellers and is not a comparison of every rental business.
Reviews must reflect genuine experience and comply with the law. Do not submit false reviews, manipulate ratings or offer benefits conditional on a favourable rating. We may moderate unlawful or rule-breaking content using the procedure in section 13. Where reviews are displayed, we will explain whether and how we check that they originate from actual users or bookings.
7. Booking and contract formation
Before you submit an order, check the Seller, item, dates, pickup and return arrangements, eligibility, cancellation conditions and total price. You can correct the information before submission. A listing or availability indication is an invitation to book rather than an unconditional promise that stock is reserved.
When you select the final payment-obligation button, you submit a booking order on the conditions shown. An order acknowledgment, temporary stock hold, payment authorization or return from a payment page is not by itself a confirmed rental. The rental agreement is formed when we issue the booking confirmation on the Seller's authority after the required payment verification and stock reservation. A status specifically marked pending is not confirmation.
If payment succeeds but the booking cannot be confirmed, we will notify you and arrange the appropriate refund or authorization release without undue delay. Do not pay again solely because a browser page or email is delayed; check the booking status or contact support. We will provide a durable confirmation with the Seller's details, rental particulars, price, cancellation conditions and applicable terms. Contact us promptly if it contains an error; this request does not shorten your legal rights.
8. Prices fees and currency
The checkout shows the total payable price, applicable taxes and mandatory charges for the booking. Optional extras require your selection. The listing and checkout must identify any amount payable directly to the Seller and any lawful security requirement before you commit. A Seller may not add an undisclosed mandatory charge at pickup.
Where shown, calendar-day prices include each stated rental day, including the start and end day. The booking must separately identify pickup and return times and the local timezone. The present booking model is one unit per booking for a maximum of 30 days unless an enabled offer expressly states otherwise. We do not collect a security deposit or automatic post-rental damage payment under that model.
The checkout currency controls the amount payable. Your bank or card provider may apply its own disclosed exchange rate or fees. We do not add currency conversion, payment or platform fees that have not been disclosed and lawfully agreed. Seller commission is a charge to the Seller under Part C unless a separate Renter service fee is expressly displayed.
9. Stripe payments
Online booking payments are processed through Stripe. When paid bookings are enabled, checkout uses a direct charge on the Seller’s connected Stripe account. Stripe collects the customer payment for that Seller and allocates Rentalee’s agreed application fee to the platform. The Seller’s account must be eligible to accept charges and receive payouts. Sellers use their own full Stripe Dashboard account, with Stripe collecting its processing fees and managing payment negative balances under the applicable Stripe terms. This configuration does not exclude Rentalee’s own legal duties or liability. The Seller is identified as the rental supplier. Stripe's applicable terms and payment-law protections apply to the payment services it supplies. Rentalee does not operate an escrow or deposit-taking service under these Terms.
The Seller authorizes payment through the payment route shown at checkout. Once the payment has been successfully collected through that authorized route, the Renter's corresponding obligation to pay the Seller is discharged, subject to a lawful payment reversal. A later payout delay or dispute between the Seller, Stripe and Rentalee does not require the Renter to pay the same validly paid amount again.
You authorize the payment for the amount and purpose displayed. A card hold is distinct from a completed charge. We do not obtain an unlimited authorization to charge damage, penalties or other later amounts merely through acceptance of these Terms. Fraud checks, authentication and legal restrictions may delay or prevent processing. This does not remove any applicable right to a refund or remedy.
Contact your payment provider promptly about an unauthorized or incorrectly executed payment, and tell us if the booking is affected. You retain applicable payment-dispute and chargeback rights. We may provide accurate transaction evidence and prevent duplicate reimbursement, but we do not impose a penalty for exercising a lawful dispute right.
10. Cancellations withdrawal and refunds
The cancellation conditions selected for your booking are displayed before the order and repeated in the confirmation. They do not replace statutory withdrawal rights or remedies for Seller failure, unsafe equipment or our own breach. A term described as non-refundable is subject to those rights.
Unless a more favourable cancellation condition is expressly agreed, our commercial cancellation policy allows a full refund of booking charges if cancellation is received at least 48 hours before the pickup time shown in the booking. For a cancellation within that period but before pickup, the Seller may retain only the amount permitted by law and reasonably proportionate to the loss caused, taking account of saved costs and replacement bookings. This does not guarantee a refund for a change of plans. No cancellation charge may exceed the booking amount.
The applicable deadline is calculated using the actual pickup time and timezone shown before booking. A calendar-date entry alone does not bring the pickup time forward to midnight. An automatic cancellation result does not decide a disputed statutory right: contact us for review of a withdrawal right, Seller failure, an incorrect deadline, saved costs or a replacement booking. A technical message saying no automatic refund was issued does not waive a refund legally due. If an outage prevents online cancellation, notify us through the published fallback email or postal contact and retain evidence; we will use the time of your otherwise valid notice when assessing the deadline.
A Consumer may have a statutory 14-day withdrawal right. Exceptions can apply, including specified-date vehicle hire or certain leisure services, but a fixed date alone does not exempt every equipment rental. The booking must identify whether a right applies and any legally supported exception. If the law requires withdrawal information and it is missing or incorrect, your rights are those provided by law, not a presumed waiver.
Where a withdrawable service starts within the withdrawal period, we or the Seller will obtain the required separate express request. A proportionate payment for performance already provided may be due only where legal conditions are met. Loss of withdrawal after full performance requires the legally required prior consent and acknowledgment. Acceptance of these general Terms alone is neither request nor acknowledgment. A separately charged platform service must be assessed independently.
If the Seller cancels, has no stock, fails to open as agreed or cannot provide a safe and materially conforming rental, you may reject an unsuitable alternative. We will administer a refund of the affected booking and associated mandatory booking charges as due, without forcing credit or rescheduling. Other statutory remedies remain available. Weather or official restrictions are assessed against the agreed safety conditions, actual ability to perform and applicable law; an external event does not automatically eliminate refund rights.
Refunds will be instructed without undue delay and within any applicable legal deadline, normally to the original payment method unless a lawful alternative is expressly agreed. Payment-provider or bank receipt times may differ from the refund instruction time. We will assist with tracing an overdue refund and will not make the Seller's payout or a third-party reimbursement a blanket condition of your legal refund entitlement.
11. Availability outages and third party systems
We will use reasonable care and professional diligence to operate the Platform. Continuous, error-free availability cannot be guaranteed. We may carry out necessary maintenance, security work and updates, taking account of existing bookings and giving reasonable advance notice where practicable.
Our service depends on communications, hosting, payment and Seller inventory systems. We will take reasonable steps within our responsibility to prevent, mitigate and remedy disruption. A fault in an external service does not automatically excuse our own failure to exercise the care required by law or contract. Existing confirmed bookings do not automatically cease because the Platform is unavailable.
To the extent the law permits, a party is not responsible for delay or failure to the extent directly caused by an event outside its reasonable control which could not reasonably have been prevented or overcome. The affected party must take reasonable steps to limit its effect and notify the other party where practicable. This clause does not excuse an existing payment debt, remove a required refund or exclude liability preserved by section 15. An ordinary preventable technical fault or a cyberattack is not automatically such an event.
12. Content and intellectual property
You keep ownership of content you submit. You grant us a non-exclusive licence to host, reproduce, format and display it to operate the Platform and promote the relevant listing, including through disclosed service providers. The licence is limited to those purposes and the period reasonably necessary, including legitimate booking, dispute and legal records after removal. It does not authorize sale of your personal data or use of your likeness for unrelated endorsement.
You must have the necessary rights and permissions, and your content must be accurate and lawful. Do not upload infringing, fraudulent, discriminatory, threatening or dangerous material or expose another person's private information unlawfully. Platform software, branding and our own content remain protected. You may not copy them beyond lawful use or a licence we expressly grant.
13. Illegal content and moderation
Use Help or Report a problem to notify us of an unlawful or unsafe listing or other content. Identify the specific content or listing location, explain the legal or safety concern and provide available supporting information. The notice process will provide the statements and contact options required by applicable law. You may also contact us using section 1. Emergency assistance should be sought from the competent emergency services.
We may remove content, limit visibility, pause listings or restrict accounts where reasonably necessary to address illegality, safety, fraud, security or a material breach of these Terms. We will act diligently and proportionately, consider relevant information and give the affected user reasons and applicable review routes unless a lawful exception prevents it. A Seller restriction is also subject to Part C.
You may challenge a moderation decision through support. Where applicable law requires an internal complaint system, certified out-of-court settlement or another redress route, we will provide the required access and information. A statutory moderation complaint may be brought during the legally required period, including at least six months where DSA Article 20 applies. Our decision does not remove your right to contact an authority or court. We do not assume a general duty to monitor every user act, but will perform the specific checks and actions required of us.
14. Privacy and communications
The Privacy Notice explains how personal information is processed, including the controller's identity, purposes, legal bases, recipients, retention, transfers and your rights. Providing that notice and accepting these Terms do not create blanket consent to marketing, optional cookies or unrelated data use. Separate consent will be sought where required, and refusing optional consent will not prevent an account or booking where the processing is unnecessary for it.
Sellers receive the information needed for lawful rental fulfilment and their legal obligations. They must protect it and may not use it for unauthorized marketing. We and Sellers may send necessary booking, security, legal and service communications. Marketing choices are separate. Rights requests can be made through section 1 or the privacy-request channel, and complaints may be made to the competent data protection authority. These Terms do not limit data protection rights or compensation.
15. Rentalee liability
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation or intentional wrongdoing; gross negligence; death or personal injury caused by our negligence or other breach where liability cannot lawfully be limited; a binding guarantee we have given; or any liability or remedy that applicable law does not permit us to exclude or limit. This includes protected Consumer, data protection and payment rights. These exceptions apply to every exclusion, cap and indemnity in these Terms.
We are not responsible for the Seller's rental performance or a user's acts merely because the parties met through the Platform. This allocation does not apply to the extent we are legally responsible, have contributed to the harm, have assumed the relevant obligation or are subject to mandatory liability. We remain responsible for our own platform service and statements under applicable law.
For Consumers, we do not impose a general monetary cap on liability for our own breach. We are not liable for a loss to the extent it was not caused by our breach or another act for which we are legally responsible. Ordinary rules of causation, proof, foreseeability and mitigation apply only to the extent permitted by the applicable law. A Consumer is not required to indemnify us against every claim connected with using the Platform.
For a user genuinely acting in business, and subject to the first paragraph of this section, our total liability for ordinary contractual damages arising from related events in a 12-month period is limited to the greater of EUR 1,000 and the platform fees paid or payable by that user to us in the 12 months preceding the first event. This cap does not limit sums we owe as an existing debt, valid refunds or Seller proceeds, or liability that cannot lawfully be capped. For such business use, we exclude loss of profit, anticipated savings, business opportunity and goodwill only to the extent lawful and not where doing so would improperly deprive an essential obligation of effect. The cap is not a limit on the Seller's rental obligations to the Renter.
16. Complaints changes and account closure
Tell us about a problem through section 1, identifying the booking and the remedy requested. We will acknowledge and handle complaints within applicable legal periods and give a reasoned response. Prompt reporting helps investigate and limit harm, but missing a preferred reporting window does not automatically extinguish a legal claim. Payment, rental, privacy and moderation complaints may require different handling. We will provide applicable accredited dispute-resolution information when required, including after an unresolved Consumer complaint, and state whether we participate or are obliged to participate.
You may request account closure at any time. Closure does not cancel a confirmed rental or erase payment obligations, refunds, claims or records lawfully retained. We may suspend access for the proportionate reasons in section 13, preserving necessary access or assistance for existing bookings where lawful and safe. We may end an indefinite Consumer platform relationship on reasonable notice for a legitimate reason, subject to mandatory rights. Sellers have the additional protections in Part C.
We may amend these Terms for changes in law, security, service functionality or commercial arrangements. We will explain material changes in advance on a durable medium where required, give appropriate notice and obtain renewed acceptance where needed. You may stop using future services and close your account if you do not agree. Confirmed bookings keep the version and conditions agreed when formed unless a later change is legally required or validly agreed without removing mandatory rights. Seller changes are subject to section 26.
17. Law language and courts
Our platform agreement is governed by Spanish law. If you are a Consumer, this choice does not deprive you of mandatory protection under any other law that applies to you, including your home-country law where the relevant conflict-of-laws rules provide it. The law applicable to the separate rental agreement remains subject to its particulars and mandatory rules; these platform Terms do not eliminate the laws applicable where the rental is supplied.
Consumers may bring proceedings before any court available under mandatory jurisdiction rules. We will bring proceedings against a Consumer only where those rules permit. We do not require Consumers to accept exclusive Benidorm courts, mandatory private arbitration, a class-action waiver or a waiver of an authority complaint.
For disputes with a user acting in business, Spanish law governs the platform agreement and the courts having territorial and subject-matter competence for the operator's establishment in Benidorm, Spain, have jurisdiction, unless mandatory law requires otherwise. Available mediation and statutory complaint rights are preserved.
English and Spanish versions are made available. The version supplied and accepted for your transaction and any mandatory language rules govern interpretation. We do not use a language-priority clause to reduce Consumer protection or override a more favourable express commitment. If a clause is invalid, it is not binding to the extent required by law and the rest continues where legally possible. An unfair Consumer term is not automatically rewritten into an enforceable maximum restriction. A delay in enforcing a right is not a waiver of it.
Part B Rental agreement adopted by Sellers
18. The rental and delivery
By listing a rental under these Terms, the Seller adopts Part B as the baseline terms of its rental agreements formed through Rentalee. The Seller and Renter are the parties to those agreements. Additional lawful category or Seller conditions apply only if disclosed before booking; a more favourable express commitment remains binding. The Seller must identify its legal name, address and contact information before the Renter commits.
The Seller must supply the agreed item, accessories and instructions in a safe, lawful condition fit for the agreed purpose, at the stated time and place. It must hold the rights, registrations, permits and insurance required for its activities and maintain the item. A material substitution requires the Renter's informed agreement. A closed shop, missing stock or undisclosed eligibility condition cannot be treated as the Renter's default.
19. Renter care safety and return
The Renter must use the item lawfully and with reasonable care, follow adequate safety instructions and comply with disclosed licence, training and use restrictions. Do not remove safety devices, make unauthorized modifications, sub-rent or allow an unauthorized or ineligible person to operate it. Notify the Seller promptly of breakdown, loss, accident or a suspected defect and stop using equipment that may be unsafe. This does not waive rights concerning an undisclosed or latent defect.
The parties should record condition and included accessories at handover and return. The Renter must return the item at the agreed time and place, subject to reasonable wear from permitted use. Extensions require agreement and available stock. A late-return charge must have been disclosed and be lawful and proportionate; it cannot be imposed simply as an undisclosed punishment. The Renter is responsible for other users only to the extent agreed lawfully or otherwise required by law.
20. Damage theft and injury claims
The Renter is liable for loss or damage only to the extent legally responsible. Fair wear, pre-existing damage and defects not caused by the Renter are excluded from that responsibility. The claimant must substantiate causation and amount under applicable evidential rules. Reasonable repair cost or depreciated value, mitigation and any insurance recovery must be considered; no party may recover the same loss twice.
A Seller making a damage claim must identify the item and incident, provide available before-and-after condition evidence and explain the amount with repair estimates, invoices or equivalent support. The Renter must receive the claim and a reasonable opportunity to respond. Rentalee may facilitate discussions or make an administrative payment/refund decision within its lawful authority, but does not replace a court or insurer. No unilateral damage charge is authorized solely by a Seller allegation or general acceptance of these Terms.
Personal injury, third-party property damage, unsafe products and criminal concerns may need immediate referral to insurers or authorities. Nothing here releases the Seller or Rentalee from its own legally imposed responsibility. There is no automatic Rentalee insurance or damage-protection fund.
21. Rental cancellations and legal remedies
Section 10 and the conditions selected for the booking govern cancellation subject to mandatory law. Seller failure, dangerous equipment or material non-conformity gives the Renter the remedies available under the applicable law and any more favourable agreed policy. The Seller must cooperate with justified refunds and complaints and issue required rental invoices. A separate contract or waiver presented only at collection cannot remove rights or add material charges that were not agreed before booking.
Part C Seller and business provisions
22. Seller eligibility and verification
The Seller must operate as a lawful professional rental business in an enabled European country. As a Rentalee onboarding policy, Sellers must provide a valid European Union VAT number that can be checked through VIES. This is our participation requirement, not a statement that every lawful European rental business must hold an intra-EU VAT registration. A valid VAT result does not by itself verify identity, insurance, rental licences or equipment safety. The Seller must also authorise its own eligible Stripe account and complete the required payment verification before accepting paid bookings. It must provide accurate legal and trading identity, address, contacts, registration and tax information, authorized representative details, payment-account information and compliance evidence reasonably required for applicable duties. It must update changes promptly. A Seller cannot use a private-person label to avoid professional obligations.
Onboarding, editorial listing review, identity checks and Stripe payment eligibility are distinct. We may request reliable supporting documents, check official sources and require corrections. The Seller is responsible for the truth of its information. We may pause trading where required information is missing, unreliable or outdated, subject to applicable law and section 26. A completed check is not a guarantee against future misconduct.
23. Seller operational and legal duties
The Seller must keep descriptions, images, stock, prices, availability, opening hours, restrictions and safety information accurate. It must honour confirmed bookings, keep its stock source current and respond promptly to synchronization failures. It remains responsible for its own duplicate inventory commitments; this does not make it responsible for an error caused by Rentalee.
The Seller must carry out the maintenance, inspections, conformity checks and recalls required for its equipment and activities; supply instructions and protective equipment where required; verify operator eligibility where justified; and notify us promptly of serious safety incidents or unlawful listings. It must immediately stop offering recalled or dangerous items and cooperate with lawful corrective action and customer notices.
The Seller must comply with Consumer, product-safety, licensing, accessibility, tax, employment and data-protection laws applicable to its rental business. It must maintain appropriate liability insurance covering its actual rental activities and legally required risks, provide evidence on reasonable request and notify us promptly of cancellation or material loss of coverage. Insurance does not replace its duties to Renters.
The Seller must give effective customer support, observe disclosed pickup arrangements, handle claims fairly, issue lawful invoices and not require undisclosed deposits, offline payments or additional terms. It must not manipulate reviews, make misleading claims about Rentalee endorsement or use the Platform for unlawful activity.
24. Seller booking authority and payment mandate
The Seller authorizes Rentalee to display its offers, perform availability checks and communicate acceptance and confirmation on its behalf when the booking requirements in section 7 are satisfied. This is a limited booking-administration mandate, not a general authority to operate the Seller's rental business or assume its supplier obligations.
The Seller authorizes use of the Stripe payment route disclosed for its bookings, deduction or allocation of the agreed platform commission and lawful payment-processing charges, and administration of cancellations and refunds in accordance with the booked conditions and mandatory rights. It must complete the applicable Stripe connected-account onboarding and comply with the provider terms it actually accepts. We do not promise that every provider duty or negative-balance risk rests on Stripe.
Payout eligibility, timing, holds and authentication are governed by the actual Stripe arrangement and applicable law. No guaranteed instant bank payout is promised. The Seller remains responsible for justified rental refunds after payout and must cooperate with funding and reversal requests. Any reserve or withholding by Rentalee must have a stated lawful basis, relate to identified or reasonably assessed exposure, be proportionate, be explained where lawful and be reviewed; it cannot become arbitrary forfeiture.
We may recover an unpaid agreed commission, a justified refund or a substantiated payment-dispute cost attributable to the Seller's breach or rental failure, using a separately authorized payment route or lawful set-off after giving a transaction-level explanation and a reasonable challenge opportunity where practicable. We will not allocate our own error to the Seller or obtain a double recovery. These provisions do not alter the rights of Stripe, an issuer or a payment user under their contracts and the law.
25. Commission tax and founding partners
The Seller’s commission rate, calculation base, applicable VAT and separately charged processing cost must be shown and accepted in its commercial schedule before it trades. Unless that schedule expressly gives a more favourable basis, commission is calculated on the customer’s rental price actually collected, including Seller rental taxes and mandatory rental charges, before deducting Stripe processing fees. Security deposits are excluded. A full refund reverses the associated commission; a partial refund requires a proportionate commission correction. An agreed commission retained on a lawful non-refundable late cancellation must be disclosed in the schedule. Rentalee VAT, where legally due on its commission, is added separately and is not Seller rental VAT. No commission exceeding that agreed schedule is authorized. The Seller is responsible for its rental tax obligations and rental invoices; Rentalee is responsible for its own commission invoices and tax obligations. A payment receipt is not necessarily a tax invoice.
For a Seller allocated a qualifying place in the current first-100 founding-business offer, there is no subscription fee, the lifetime marketplace commission ceiling is 15% before any VAT legally due on that commission, and a 25% discount applies to the otherwise applicable commission rate for the first 3 calendar months from its first live listing. At the standard 15% rate this means 11.25% during those 3 months, then 15%. This is a discount on our commission, not on the rental price. The discount ends at the recorded anniversary, using calendar months without overflowing the month end; it applies to bookings created during the introductory period and does not restart after a pause. A place is allocated sequentially when the Seller first uploads a rental or imports a rental through its authorised connection, while places remain; the rental may still be a draft or awaiting review. Registration or clicking the claim button alone does not reserve a place. The three-month discount starts only when the Seller's first approved listing goes live, not on upload. The displayed remaining-place count reflects allocated places and does not guarantee a place until allocation. One place is allowed per qualifying legal business. Existing Sellers with an accepted earlier 0%-for-12-months offer retain that agreed benefit and its recorded end date; this new offer does not replace it. After any introductory period, the applicable rate is the rate accepted in the commercial schedule, never above the promised lifetime ceiling. Applicable commission VAT and standard Stripe processing fees are additional. The 15% ceiling does not include commission VAT. No fee may be disguised as commission to circumvent the ceiling. The founding number, offer version, first-live-listing date and promotional end date are recorded. The benefit remains with the same qualifying Seller business during participation, including a documented pause and resumption. Transfers to a different legal business require written agreement; a trading-name change alone does not remove the benefit. An accepted founding benefit cannot be withdrawn or narrowed through a general unilateral amendment.
The optional hosted RentalPlugin service in the Seller workspace is separate from marketplace discovery. There is no software subscription for this hosted edition. Online bookings made through its Seller-website widget or hosted Seller-website booking page carry 15% commission from the first booking, plus applicable VAT on that commission and separate Stripe processing fees. The founding introductory marketplace discount does not apply to this separate website-booking channel; any lower expressly agreed lifetime ceiling remains respected. The Seller must actively accept this service and fee before enabling it. Front-desk reservations do not process an online payment. Sellers may record actual offline payments and issue receipts for those recorded amounts; the Seller is responsible for their accuracy. This hosted edition does not include every feature of the separate GROW WordPress product. The Seller must not present an unpaid reservation or prepared, unsigned contract as proof of payment or signature.
The founding package also includes free assisted setup of the Seller’s initial Rentalee listings (photos, descriptions, prices, opening hours and rental rules), a Founding Business badge on its shop and listings, and a personalised digital QR poster design linking to its Rentalee rentals, which the Seller can download and print itself. Printing and postage are not included. The Seller remains responsible for accuracy and approval. Setup requests are reviewed for eligibility; requesting help does not reserve a founding place. Website redesigns, third-party subscriptions and ongoing administration are not included. The badge recognises founding participation, not quality certification or search priority. The poster is available after a founding place is allocated and an approved listing is live. No bookings, income or marketing reach are guaranteed.
The Seller must supply information reasonably required for lawful tax due diligence and platform reporting, including DAC7 where applicable. We may make legally required reports and corrections and explain the data use in the Privacy Notice. Zero commission does not itself create a reporting exemption. Both parties must keep required records.
26. Seller restriction termination and changes
We may restrict a listing or Seller for illegal or dangerous offers, fraud, material or repeated breach, payment eligibility failure, missing required information or a binding legal requirement. We will choose a proportionate measure, normally focusing on the affected listing where adequate. We will provide reasons on a durable medium before or when a restriction or suspension takes effect, subject to legally permitted exceptions.
Where P2B applies, termination of all intermediation services ordinarily requires a reasoned notice at least 30 days in advance. Shorter or immediate action is limited to the statutory exceptions, including an incompatible legal obligation, a legally recognized imperative reason or demonstrable repeated infringement. A general right to terminate at will does not override these protections. We will give the reasons and opportunity to clarify facts required by law and reinstate access without undue delay when a decision is reversed.
Material Seller-term changes will be notified on a durable medium at least 15 days before application where P2B requires, with a longer period where necessary for technical or commercial adaptation. Shorter notice or a waiver is effective only under the legal conditions. The Seller may terminate within the applicable notice period. Changes are not retroactive except where law permits, and do not defeat accrued founding benefits or confirmed bookings.
On exit, the parties must resolve existing rentals, lawful refunds, outstanding balances and required customer support. Account restriction does not itself confiscate Seller proceeds. The Seller may request export of its listing and booking information that it is entitled to receive, subject to security, privacy and legal retention. Export and lawful settlement survive closure for the period needed to complete them.
27. Seller data distribution and complaints
We access account, listing, booking, transaction and support information to operate the marketplace and comply with law. A Seller can access its own listings and the booking information provided for its rentals, including fulfilment details, dates, charges and status. It does not obtain unrestricted access to other Sellers' records, customer payment credentials or unrelated personal data. Platform analytics may be used in aggregated or otherwise lawful form. Necessary provider access and retention are explained in the Privacy Notice.
Listing content may be displayed on Rentalee and through hosting, search-indexing and technical providers needed to deliver it. We do not obtain an unrestricted right to appoint unrelated resale channels; any additional distribution programme and material conditions will be disclosed before participation. Search ranking follows section 6. Material differentiated treatment of our own or related-party offers, or paid ranking influence, must be disclosed before it applies.
The Seller normally acts as an independent controller for its rental fulfilment and legal records and must give its own required information. It must not treat booking data as consent to marketing. Any actual processing solely on another party's instructions or joint determination requires the appropriate separate data agreement. Each party must cooperate on relevant incidents and rights requests.
Sellers may complain free of charge through section 1 about our conduct, technical problems or decisions. We will consider the facts, provide a reasoned outcome and allow clarification. If mandatory law requires designated mediators or another formal system, the applicable Seller schedule must identify them and their procedure before trading. We will cooperate in good faith as required, without preventing court access. Statutory small-enterprise exemptions do not remove other applicable Seller protections.
28. Seller indemnity and business responsibility
To the extent permitted by law, the Seller will indemnify Rentalee for substantiated third-party claims and reasonable, properly incurred defence costs to the extent caused by the Seller's breach of these Terms, unlawful or unsafe rental supply, infringement of third-party rights, unlawful data use, negligence or intentional misconduct. This does not cover a loss to the extent caused by Rentalee's own breach, negligence or other conduct for which Rentalee is responsible. Shared responsibility is apportioned according to applicable law.
We must notify the Seller reasonably promptly, provide relevant information and mitigate loss. The Seller may participate in or, where appropriate and lawfully agreed, conduct the defence using competent counsel. Neither party may settle a claim in a way that imposes an admission, non-monetary obligation or unreimbursed payment on the other without its reasonable prior agreement. Delay in notice reduces recovery only to the extent it materially prejudices the defence. An indemnity does not transfer a regulatory fine or liability that the law prohibits transferring.
The cap on Rentalee's ordinary business liability in section 15 does not cap the Seller's own obligations to Renters or its justified payment debts and indemnity under this section. The Seller is not responsible for all acts of unrelated users or for an unproven allegation. Nothing in this section limits a Renter's rights against a party legally responsible to them.
Part D Consumer withdrawal form
29. Model notice where a withdrawal right applies
To: the Seller identified in the booking, at its disclosed postal or email address. Copy to Rentalee through the contact in section 1 where Rentalee administers the booking. For withdrawal of a separately contracted Rentalee platform service, address the notice to Rentalee.
I hereby give notice that I withdraw from my contract for the following rental or service: __________. Booking reference: __________. Ordered on: __________. Consumer name: __________. Consumer address: __________. Date: __________. Signature, only if sent on paper: __________.
You may use this form or another unequivocal statement. Use the contact of the relevant contracting party and send the notice within the applicable withdrawal period. This form does not create an exception to withdrawal or remove a right where the booking incorrectly states that it is exempt.
